Gut Health Hub Terms of Use

These terms cover your use of the Gut Health Hub at guthealth.colonoscopybrisbane.com.au (the Hub), provided by Colonoscopy Brisbane (ABN 53 149 949 077).
By creating a Hub account you accept these terms. If you do not accept them, please do not create an account.
1. What the Hub is
The Hub is a general gut-health education service. It gives you plain-English learning material, optional self-tracking tools, and information about services the practice offers.
2. What the Hub is not
The Hub does not provide medical advice, diagnosis or treatment, and using it does not create a doctor–patient relationship.
- Nothing in the Hub is tailored to your individual circumstances, even where you enter your own information.
- The Hub does not tell you whether you need a procedure, a test, or any other care. It does not assess your risk.
- For advice about your own health, symptoms, diagnosis or treatment, speak to your doctor. For personal dietary advice, speak to an Accredited Practising Dietitian.
- If you are worried about your health right now, contact your doctor. In an emergency call 000.
Having a Hub account does not make you a patient of the practice, and does not give you access to a patient record, appointments or clinical documents. Those appear only if your account is separately linked to an existing patient record by our team.
3. Who can join
You must be 18 or older and have an Australian mobile number. One account per person. Do not create an account for someone else or share your sign-in details.
4. Verifying your email and mobile
We email you a single-use link and text you a code. These confirm that you control that address and that number at that moment. They are not identity checks and we do not treat them as proof of who you are.
Standard carrier charges may apply to text messages you receive.
5. Free features, the Toolkit, and the trial
Some Hub features are free to everyone. The rest can be unlocked in one of two ways, and you choose which suits you:
- Full access — A$49, GST inclusive, paid once. This unlocks every paid part of the Hub. It also covers anything we add later: if we publish a new course or tool after you buy, it is included at no extra cost, for as long as your account is open. There is no subscription and nothing renews.
- A single course — priced per course, GST inclusive, paid once. If you only want one topic, you can buy just that course. It stays available to you on the same terms. Buying courses individually does not build towards full access, so if you expect to want several, full access is the better value.
Current prices are always shown in the Hub before you pay. We may change prices for future purchases; a change never affects something you have already bought.
Free trial: if a trial is offered to you, it runs for 30 days. No card is required and it does not renew automatically. When it ends it simply stops, you are not charged, and you are not asked for payment details. You can only take one trial.
6. Payments
Payments are processed by Stripe. We do not receive or store your card details.
7. Refunds and your consumer rights
The Hub comes with guarantees under the Australian Consumer Law that cannot be excluded. Nothing in these terms limits them, and nothing we say to you overrides them. In plain terms, the Hub must be provided with due care and skill, be reasonably fit for the purpose we describe, and match how we have described it. These guarantees apply to digital products and online services just as they do to anything bought in a shop.
If something goes seriously wrong — a major failure, such as the Toolkit being substantially unusable or significantly different from our description — you choose the remedy. You can cancel and ask for a refund of the amount relating to what you did not receive, and you may also claim compensation for reasonably foreseeable loss.
If something goes wrong in a smaller way, we will put it right within a reasonable time. If we do not or cannot, you can then cancel and ask for a refund.
Our own refund policy, on top of those rights. If you buy full access or a single course and it is not what you expected, email us within 14 days of purchase and we will refund it in full, provided you have not completed a substantial part of the content you bought. You do not need to give a reason.

8. Your content, and getting it out
Anything you record in the Hub — diary entries, notes, saved items — stays yours. You can export it or delete it at any time from the Hub’s data page.
Some of what you write may be health information. How we collect, store and handle it is set out in our Privacy Policy, which forms part of these terms.
If you choose to share a summary with the practice, that summary is copied into your patient record and becomes part of your clinical file. Clinical records are retained under health-records law and cannot simply be deleted on request — this is the one thing you cannot take back by deleting your Hub data.
9. Emails and messages
Security and service messages (verification, receipts, account notices) are part of running your account and are not optional.
Learning updates and other marketing emails are separate, optional, and only sent if you opt in. You can withdraw that consent at any time, in the Hub or by using the unsubscribe link.
10. Changes to the Hub
We may add, change or withdraw Hub features, and may change which features are free. We will not withdraw access you have already paid for, and if you hold full access, anything we add is included (clause 5).
11. Suspension and closure
We may suspend or close an account that is used to break these terms, to abuse the service, or unlawfully. You can close your account at any time by contacting us.
Closing your Hub account does not delete your patient record, if you have one.
12. Availability
We aim to keep the Hub available but do not guarantee uninterrupted access. The Hub is not a way to contact the practice urgently. Never use it to report a symptom that needs attention — phone the practice, or call 000 in an emergency.
13. Our liability
What we do not limit. The Australian Consumer Law gives you guarantees that cannot be excluded, restricted or modified. Nothing in these terms attempts any of those things. Where the law makes us liable, we are liable.
Two consequences follow, which we state plainly because online terms often get them wrong:
- The Hub is a service of a kind ordinarily acquired for personal use. That means we are not permitted to cut our liability down to merely supplying the service again, and we do not try to.
- We do not exclude liability for death or personal injury caused by our negligence.
What these terms do limit, but only as far as the law allows: we are not liable for loss that was not reasonably foreseeable, or for indirect or consequential loss, arising from your use of the general educational information in the Hub.
The boundary that matters most. The Hub gives general information; it is not care. If you receive clinical care from the practice, our responsibilities for that care come from that treating relationship and the law governing it — not from these terms, and nothing here reduces them.
Availability. We are not liable for loss caused by the Hub being temporarily unavailable, except where we have failed to use due care and skill.
14. Changes to these terms
If we change these terms materially, we will publish a new version and ask you to accept it. The version you accepted is recorded against your account.
15. Governing law
These terms are governed by the laws of Queensland, Australia.
